Terms of Service
These Terms of Service ("Terms") are an electronic record under the Information Technology Act, 2000 and form a binding agreement between you ("User", "you") and Quizophrenia Pvt Limited ("Company", "we"), operator of the Quizophrenia website and Zvibe mobile application (the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Nature of the Platform
Quizophrenia / Zvibe is a 100% free-to-play social gaming, content, and e-commerce platform.
- All games on the Platform are games of skill, where outcomes depend predominantly on the player's mental and physical skill, knowledge, training, and experience — recognised as legal under Article 19(1)(g) of the Constitution of India and affirmed by the Supreme Court of India in State of Andhra Pradesh v. K. Satyanarayana (1968) and K.R. Lakshmanan v. State of Tamil Nadu (1996).
- No entry fees, no wagers, no monetary stakes, no real-money gaming. Gameplay is and will always remain free for all users.
- Tournaments are free to enter. Winners receive real-world physical gifts (electronics, gadgets, apparel, food, lifestyle goods) — never cash payouts.
- The Platform is not a gambling, betting, or wagering service, and is not a real-money fantasy-sports operator. Our free-to-play Fantasy Cricket feature is a skill-based prediction game with no entry fees and no monetary stakes — fundamentally distinct from paid fantasy-sports platforms. The Platform does not facilitate any activity prohibited under the Public Gambling Act, 1867 or any State legislation.
- Revenue is generated solely from advertising, affiliate partnerships, tournament sponsorships, and e-commerce sales.
1A. Tournaments & Prize Rewards
- Entry: All tournaments are 100% free to join. No fees of any kind.
- Re-entry on elimination: Eliminated players may re-enter by watching a short rewarded ad. No payment is involved at any stage.
- Winner determination: Weekly and monthly winners are determined purely from leaderboard position based on game performance.
- Prizes: Physical goods only — never cash, never digital wallet credits convertible to cash.
- KYC: Before any prize is dispatched, the winner must complete an Aadhaar & PAN-based KYC. This is a statutory requirement under Indian tax and consumer-protection law.
- Taxation: Any TDS / income-tax liability arising from the prize value (under Section 194B / 194BA of the Income Tax Act, 1961, where applicable) is borne entirely by the Company; the winner pays nothing.
- Shipping: Prizes are shipped at the Company's cost to the address provided in the winner's KYC. Failed-delivery, address-fraud, or ineligible-recipient cases may result in forfeiture.
- Disqualification: Detected use of bots, multi-accounting, or any unfair-advantage tool results in immediate disqualification; the prize is awarded to the next eligible position.
2. Eligibility
- You must be at least 13 years old to create an account.
- You must be at least 18 years old to make purchases or sell on the Platform.
- You must be a resident of a jurisdiction where use of the Platform is lawful. Users in the states of Andhra Pradesh, Tamil Nadu, Telangana, Sikkim, Nagaland, and any other state where any feature of the Platform is restricted by local law are expected to refrain from using such features.
- You must not be barred from receiving services under the laws of India.
3. Account & Security
- You are responsible for maintaining the confidentiality of your account credentials.
- One person may operate only one account. Multi-accounting for unfair advantage results in permanent ban.
- Authentication is via OTP-verified mobile number; we may require re-verification at our discretion.
4. User Content & Conduct
By posting content (chat, stories, community posts), you grant us a non-exclusive, royalty-free, worldwide licence to host, display, and distribute that content on the Platform.
You will not post content that:
- Is unlawful, defamatory, obscene, pornographic, paedophilic, or invasive of privacy.
- Promotes gambling, hate speech, terrorism, or harms minors.
- Infringes intellectual property rights.
- Violates Rule 3(1)(b) of the IT (Intermediary Guidelines) Rules, 2021.
We act as an intermediary under Section 79 of the IT Act, 2000 and disable access to non-compliant content within 36 hours of receiving valid notice.
5. E-commerce
Products listed on the Platform are sold by registered third-party sellers or directly by us. The Consumer Protection (E-Commerce) Rules, 2020 apply. Pricing displayed is inclusive of GST where applicable. Refunds and cancellations are governed by the Refund & Cancellation Policy.
6. Anti-Cheat & Fair Play
- Use of bots, automated scripts, modified clients, or any third-party tool that gives unfair advantage is prohibited.
- Server-authoritative validation is in force on all multiplayer games. Detected violations result in match forfeit, leaderboard reset, and account suspension.
7. Intellectual Property
All Platform content (excluding user-generated content) — including game designs, source code, logos, trademarks "Quizophrenia" and "Zvibe", and visual assets — is the exclusive property of the Company and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.
8. Disclaimers & Limitation of Liability
The Platform is provided "as-is". To the maximum extent permitted by law, the Company is not liable for indirect, incidental, or consequential damages. Our aggregate liability for any claim shall not exceed the amount paid by you to the Company in the 12 months preceding the claim, or ₹1,000 — whichever is greater.
9. Termination
We may suspend or terminate your access for breach of these Terms, illegal use, or by direction of any lawful authority. You may delete your account at any time from in-app settings.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Disputes shall first be attempted to be resolved through good-faith negotiation. Failing that, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator at Sreebhumi, Assam. Subject to arbitration, courts at Sreebhumi, Assam shall have exclusive jurisdiction.
11. Grievance Redressal
For complaints, contact our Grievance Officer (details on the Contact page). Acknowledgement within 24 hours; resolution within 15 days as mandated by Rule 3(11) of the IT (Intermediary) Rules, 2021.
12. Changes
We may revise these Terms; material changes will be notified at least 7 days in advance. Continued use after the effective date constitutes acceptance.
